The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney.

On or about December 18, 2017, through February 15, 2018, an LVN from Houston failed to make skilled nursing visits as ordered. During the said day, the LVN also failed to notify the physician of missed skilled nursing visits. Her conduct deprived the physician of information that could be required to institute timely medical interventions in the event the patient experienced a change in condition.

In response, the LVN states there were no visits scheduled for her to do in the system and only after mid-January had she learned of visits being set up for her to see the patient. She explains that after several calls and drive-by attempts were made, she finally found the patient at home to do a recertification visit on February 15, 2018. According to the LVN, the patient informed her he was not home on multiple days due to having extensive dental work. She claims she contacted the daughter and asked if continual services were needed. The LVN states she requested the start of care orders from the MD and notified their office of multiple missed visits.

However, the LVN failed to properly present and defend her case against the court. She was disciplined warning to a suspension of her license by violating the Texas Board of Nursing regulation.
