The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney.
One of the best examples where a client failed to hire the right nurse attorney will be discussed in this case.
On or about March 16, 2010, through March 25, 2010, the RN, moved clients in and out of the home in an attempt to misrepresent the TDADS Surveyors the actual number of clients residing in the home. She also failed to dispose of medications that were left in the home by discharged clients. Instead, she used the medications for other clients living in the home. Her conduct was deceptive and was a violation of Chapter 483 of the Texas Health and Safety Code (Dangerous Drug Act).
Because of this, the RN was summoned by the Texas Board of Nursing to hear her side of the story. In response, the RN states that, in regard to administering the IV medication, the physician’s order was for a skilled nurse to administer the medication and it did not specify an RN.
During the defense, the RN states she thought she was allowed to remove medications from patients’ homes when she removed the medication from the patient’s home per their request.
However, the RN failed to properly present and defend her case against the court. She was disciplined warning to a suspension of her license by violating the Texas Board of Nursing regulation.
