Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. On or about November 24, 2017, while employed as a Licensed Vocational Nurse in a medical facility in Sweetwater, the LVN allegedly administered a breathing treatment to an out-patient, who was not a resident of the facility, and without first consulting a physician. Her conduct exposed the out-patient to risk of harm in that the administration of a breathing treatment without a physician’s consultation could result in the out-patient suffering from adverse reactions.
In response to the allegations, the LVN states a resident’s husband was complaining of chest pain and shortness of breath. Upon entering the room, the out-patient was hunched over holding his chest, grimacing, and stating he could not breathe. She states she obtained what reflected an elevated blood pressure, and oxygen saturation was 74% initially. She states she advised to call for 911. The ADON applied three liters of oxygen. The ADON administered nitroglycerine from the out patient’s personal prescription. His saturation continued to drop into the lower 60s and at that time the LVN states she suggested a breathing treatment. The nurse set up the nebulizer, administered the medication onto the mask and handed it to the LVN to place on his face.
The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
