Any type of allegations or accusations at work can be defended, as long as there is a skilled nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.

Accusations regarding negligence are a must to be observed properly not only by the Board but by a nurse attorney. An example of this happened to an LVN in Lubbock wherein several accusations are filed against her negligence at work.

On or about May 26, 2017, the LVN allegedly failed to document an assessment in the medical record of a patient. In addition, the LVN failed to administer Levothyroxine ordered at 8 am. Her conduct may have resulted in an incomplete medical record, and exposed the patient to a risk of harm in that failure to administer medications as ordered by the physician could have resulted in the non-efficacious treatment of the patient’s condition.

During the hearing, the LVN states that she was called into the Director’s office around nine (9) in the morning, causing the delay of all of her medications for her patients. She states that she was informed that she was being suspended regarding the previous weekend’s infractions. She states that she was unable to complete her documentation on these patients.

However, with the failure to hire an experienced nurse attorney to help her defend her side, the LVN never had the chance to defend her side of the story.

Because of this incident, the Texas Board of Nursing then subjected the LVN and her license into disciplinary action.
