An RN or LVN who violates the state laws and issuances from the Texas Board of Nursing (BON) should seek proper help from a nurse attorney.  Doing so could make or break their cases. As a matter of fact, the license can even be suspended or revoked if not defended properly.

According to the accusations, the RN inappropriately administered Tuberculin skin (TB) testing to staff using half of the recommended amount of Tubersol for testing, and inappropriately accepted submission of photographs from staff to her personal cell phone instead of the required in-person assessment and reading of the results. Her conduct deceived her employer and may have placed coworkers at risk of injury from inappropriate and non-efficacious TB testing.

During the defense, the RN states that she discussed giving half the dose with another co-worker and did some quick research but couldn’t find anything that stated it would be less effective to give only half the recommended dose during the times when the hospital had a low supply of Tubersol. She further states that she thought it was better to give the employees some type of testing, rather than turn away multiple employees. She continues by stating that she did accept photographs from staff for verification of their tuberculin skin test results.

Because of the incident, the RN was disciplined and suspended by the Board of Nursing.

The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN license.  The Board has the power to suspend and/or revoke the nurse license.  It is also the agency that is responsible for overseeing the practice of professional nursing all over the State of Texas.
