Further, she failed to document that she administered diazepam to the patient, nor did she type error to the patient’s treating physician and/or Director of Nursing (DON).
The LVN’s conduct was likely to injure the patient in that failing to administer medications as ordered by the physician could result in non-efficacious treatment. Additionally, her conduct created an inaccurate and incomplete medical record and deprived the treating physician of information required to institute medical interventions to prevent future complications.
The Texas Board of Nursing is the one that has full jurisdiction on cases involving RNs and LVNs. Therefore, the LVN was summoned by the Texas Board of Nursing to explain her side.
During the hearing, the LVN states that one day, when she was about to administer medication to the patient, she realized she accidentally grabbed the wrong one and dropped it. She states she didn’t want to make a fuss or worry the mother, so she cleaned up her mess and administered the correct medication. The LVN states the following week, she told the patient’s mother that the medication was almost finished and the mother reported this to the case manager.
Because of this, the Texas Board of Nursing suspended and disciplined the LVN.
