On or about June 20, 2002, an LVN from Houston accepted an assignment in a Coronary Care Unit to care for a patient, when she lacked the knowledge and experience to function as a Coronary Care Nurse. The ventilator alarm indicated that the patient may have been experiencing a cardiac arrest and the LVN, who was not familiar with cardiac equipment, was unable to institute the appropriate intervention to stabilize the patient.

On or about September 16, 2002, the LVN engaged in the intemperate use of marijuana. She produced a specimen for a pre-employment drug test which tested positive for marijuana. Possession of marijuana is prohibited by Chapter 481 (Controlled Substances Act) of the Texas Health & Safety Code. Marijuana is a controlled substance and the use of marijuana by a registered nurse, while subject to duty or call, could impair the nurse’s ability to recognize subtle signs, contra symptoms, or changes in the patient’s condition and could impair the nurse’s ability to make — –rational, accurate and appropriate assessments, judgment and decisions regarding patient within care, thereby placing the patient in potential danger.

Because of this, the LVN was summoned by the Texas Board of Nursing to defend her side.

Because of the incident, the LVN was disciplined and suspended by the Board of Nursing.

The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN license.  The Board has the power to suspend and/or revoke the nurse license.  It is also the agency that is responsible for overseeing the practice of professional nursing all over the State of Texas.
