Any accusations of medical negligence should never be taken lightly. Even if you are certain that you have done nothing to such allegations, do not face the charges alone. On or about February 3, 2019, through February 4, 2019, while employed as a Licensed Vocational Nurse in a medical facility in Houston and assigned to provide private duty nursing care to a patient, the LVN allegedly failed to document and accurately and completely document skilled nursing care in the patients medical record, including oxygen saturation levels on the ventilator flow sheet.

Her conduct resulted in an incomplete medical record and exposed the patient to a risk of harm in that subsequent care givers would not have accurate and complete information on which to base their care decisions.

In response to the incident, the LVN states that she was informed that her documentation for the shift was incomplete and was given the opportunity to do paper notes for her shift, because due to technical difficulty apparently not all her documentation had been saved. She states she indeed documented and saved all of her entries as required every two hours.

The LVN was asked to explain how she saved her documentation and it was then brought to her attention that she was missing a step. She adds that she was never at any time informed by any supervisor of issues with medication administration, and she signed and administered all medications, water flushes, and a nebulizer treatment.

Because of this incident, the Texas Board of Nursing then subjected the LVN and her license into disciplinary action.

Always remember that if a patient thinks she has been hurt or injured as a result of an LVN proving or failing to provide professional services, that particular patient could sue the nurse. But that doesn’t mean the LVN have been negligent.
