On or about May 15, 2016, while employed as a Licensed Vocational Nurse in a hospital in Conroe and on duty as the triage nurse in the 1200 Clinic, the LVN failed to assess a patient when the patient was brought to the clinic by security personnel exhibiting unusual and combative behavior. Further, the LVN failed to notify a provider of security personnel’s report that the patient may have ingested medication(s) not prescribed to him. She took a lunch break without reporting to another nurse or ensuring that another nurse assessed a patient. Subsequently, the patient was found unresponsive by another nurse, cardiopulmonary resuscitation (CPR) was initiated, and the patient was emergently transported to an acute care facility, where he was pronounced deceased.

The LVN’s conduct deprived the patient of the benefit of timely medical intervention and may have contributed to the patient’s demise.

In response to the incident, the LVN states this was not her patient and she was on her lunch break when the patient was brought to the clinic. She states the detention officers who brought the patient to the clinic gave a report to another nurse, not to the LVN. The LVN states the patient was screaming, yelling profanities, kicking, and thrashing upon arrival in the clinic.

The LVN states when another nurse went to assess the patient, the nurse summoned the LVN and told her the patient was not breathing. She states she immediately called a doctor and was instructed to start CPR.

 

The Texas Board of Nursing has full jurisdiction over all cases that may affect the LVN license. The strictness of the Board also ensures that nurses will only commit to the duties they are assigned to in order to guarantee accurate and excellent performance in all hospitals throughout the state of Texas.

 

As a result, the Texas Board of Nursing decided to sentence her LVN license to disciplinary action to ensure that she will never commit such acts again.
