Nursing is bound to all rules and laws. These rules and laws are set to see or ensure that patients are receiving quality care and promote patient safety. But if an RN violates any of the laws, the Board can subject an RN into disciplinary action, license suspension, or revocation. An incident happened on or about September 3, 2018, through September 29, 2018, while an RN was employed at a hospital in Brownsville, Texas. The RN withdrew two (2) tablets of Benadryl 50mg and seven (7) tablets of Phenergan 25mg from the medication dispensing system for patients but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications. The RN’s conduct left medications unaccounted for and was likely to deceive the hospital pharmacy.

Another incident on or about September 3, 2018, through September 29, 2018, the RN misappropriated one (1) tablet of Benadryl 50mg, one (1) tablet of Phenergan 25mg, one (1) tablet of Benadryl 50mg for, one (1) tablet of Phenergan 25mg, one (1) tablet of Phenergan 25mg, one (1) tablet of Phenergan 25mg, one (1) tablet of Phenergan 25mg, one (1) tablet of Phenergan 25mg for and one (1) tablet of Phenergan or failed to take precautions to prevent such misappropriation. The RN’s conduct was likely to defraud the facility and patients of the cost of the medications.

In regards to the incident, the RN denies misappropriating medications. The RN states that she has a longstanding history of chronic migraines and sees a neurologist, but despite his regime to control the migraines there are times they become debilitating and she has to go to the emergency room to have them treated with IV hydration, [V nausea, and pain medications. The RN states she self-reported to the Board of Nursing and requested an investigation. And also she submitted several character reference letters from co-workers supporting her.

Due to the violation made by the RN, the Board decided to subject the RN to disciplinary actions. The decision of the Board is based upon the evidence received which is sufficient enough to put the RN into disciplinary action. If only the RN had hired a nurse attorney for her case, the decision of the Board could have led to a different outcome.
