Every practicing RN license holder in the state of Texas is required to follow certain rules and regulations imposed by the government. These laws and statutes were implemented to ensure that the safety of the patients is protected by the state. An RN who commits any violation can place her RN License in jeopardy. The Texas Board of Nursing has the authority to revoke or suspend an RN license in the country for as long as there is a justifiable reason. Failure to hire a nurse attorney could lead to RN license suspension.

An incident happened to an RN in 2018. At the time of the initial incident, she was employed as an RN with a pediatric care institution in Grand Prairie, Texas, and had been in that position for three (3) months.

On or about September 2, 2018, through October 28, 2018, while employed as an RN, working as a Home Health Nurse with a pediatric care institution in Grand Prairie, Texas, and providing care for Patient JS, a nine-year-old tracheostomy dependent patient, RN failed to report vital signs persistently outside normal parameters to the physician. Subsequently, the patient experienced cardiac arrest on October 30, 2018, and died. RN’s conduct was likely to injure the patient from lack of medical treatment for vital signs out of normal range.

In response, RN reports on October 27, 2018, she accompanied the mother of the patient and the patient to the Emergency Department for dramatically out of range vital signs. RN reports the patient tested positive for rhinovirus, the doctor wanted to admit the patient, but the mother refused, fearing the patient would get Methicillin-resistant Staphylococcus aureus (MRSA). RN reports for the rest of her shift, and the next shift, the patient’s vital signs remained elevated, but as the patient had been assessed by the emergency room physician, she continued to monitor and document the patient’s vital signs.

On or about October 13, 2018, while providing care for Patient JS, RN failed to notify the physician and/or supervisor of the patient’s surgical incision dehiscence. Instead, she notified the mother of the patient and applied a Mepilex dressing. RN’s conduct was likely to injure the patient from lack of medical treatment for surgical incision dehiscence.

In response, RN reports she applied a mepilex dressing to the slight incision dehiscence and notified the patient’s mother.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and are a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(D),(1)(M),(1)(P)&(3)(A) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B(& (4).

Unfortunately, the Texas Board of Nursing found her guilty of her deeds. Her RN license was subjected to disciplinary action. She did not hire a skilled Texas BON attorney to fully defend her case which led to this decision by the Texas Board of Nursing.
