This is the incident that happened to an LVN in 2019. At the time of the incident, she was employed as an LVN in a skilled nursing facility in Brownsville, Texas, and had been in that position for one (1) month.

On or about January 11, 2019, while employed as an LVN in a skilled nursing facility in Brownsville, Texas, LVN administered Vancomycin through the dialysis catheter of a patient without a physician’s order to use the dialysis catheter for this purpose and against facility policy. LVN’s conduct was likely to injure the patient from dialysis catheter complications.

On or about July 2, 2019, LVN failed to provide a safe environment for Patient C by sending him home with another patient’s medication. On July 9, 2019, the Quinapril blister pack was retrieved with pills missing, indicating that Patient C had already taken some of the medication. LVN’s conduct exposed the patient to adverse effects of medication that was not prescribed by a physician, including low blood pressure.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and are a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C)&(1)(M) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4),(6)(G)&(11)(B).

The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
