Any RN in Texas may be subjected to a disciplinary proceeding before the Texas Board of Nursing. Whenever an LVN or an RN finds himself in such a situation, he will need to find the best nurse attorney in the country. This is important, as it is his only chance to protect his RN / LVN license. This is the incident that happened to an RN in 2019. At the time of the incident, he was employed as an RN at a hospital in McAllen, Texas, and had been in that position for one (1) year and nine (9) months.
On or about May 19, 2019, through May 20, 2020, while employed as an RN at a hospital in McAllen, Texas, RN failed to intervene and notify another physician, and/or escalate up the chain of command when the provider did not return RN’s calls, after a patient experienced a change in condition following surgery, including increased drowsiness with response only to painful stimuli, hypotension and decreasing urinary output. Additionally, RN waited approximately two (2) hours after noting the aforementioned patient’s change in condition before activating the Rapid Response Team; the patient was subsequently intubated and transferred to the Intensive Care Unit (ICU). RN’s conduct resulted in a delay in emergency treatment for the patient that was needed to prevent further complications and may have contributed to the patient’s subsequent demise.
In response, RN states he made several attempts to contact the on-call physician throughout the shift. RN further states he notified the house supervisor when the physician did not respond.
The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and are a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(M)&(1)(P) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B)&(4).
The Texas Board of Nursing decided to impose disciplinary actions on the RN and his license. It’s because he failed to hire an expert nurse attorney for the case, which is why his defense was not matched with the evidence that the Board possesses.
