Any RN in Texas may be subjected to a disciplinary proceeding before the Texas Board of Nursing. Whenever an LVN or an RN finds himself in such a situation, she will need to find the best nurse attorney in the country. This is important, as it is her only chance to protect her RN/LVN license. On or about November 3, 2017, while employed as an RN at a hospital in Plano, Texas, RN failed to adequately intervene for a patient, when the patient complained of pain and exhibited aggressive behavior, and refused morning medications, including Cymbalta, Namenda, Toprol XL, Zoloft, Lovenox, and Norco. RN failed to notify the physician regarding the patient’s change in behavior and refusal to take scheduled medications and requested alternatives to medication administration and/or administration. RN’s conduct was likely to injure the patient in that failure to administer medications as ordered by the physician could have resulted in the non-efficacious treatment of the patient’s condition.

 

In response, RN states she would have never ignored a patient’s complaints of pain and would have assessed all aspects of the patient’s pain. RN states she would have assessed the patient’s pain utilizing the Clinically Aligned Pain Assessment (CAPA) and addressed the incident with the Charge Nurse on duty to de-escalate the situation. RN states she is unable to provide any further information and is residing in Minnesota.

 

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code. The Texas Board of Nursing gave the RN sufficient time to defend the complaints filed against her. However, there was a failure on the RN’s part to find the right RN/LVN license attorney to handle her case. The negligence of the RN/ LVN license attorney led to the decision of the Texas BON to impose disciplinary action on the RN’s license.
