At the time of the initial incident, the LVN was employed as a Licensed Vocational Nurse at a hospital in Amarillo, Texas, and had been in that position for one (1) year and one (1) month; and had been in that position for one (1) year and two (2) months.
On or about April 3, 2020, through September 7, 2020, an RN was assigned to provide private duty nursing care for a patient and accepted another assignment to provide private duty nursing care for another patient at the exact same time. As a result, both visits were billed (for 12 hours each) and the RN was paid by both agencies, totaling 24 hours, for the same hours provided to both patients. The RN’s conduct was likely to defraud both facilities and Medicaid of monies paid for the same hours of nursing care.
In response, the RN states she had a meeting with the facility regarding their investigation into the two patients and informed the Director of Nurses (DON) that she worked two cases within the same home.
The RN states she was truthful when she disclosed upon hire that she worked for two different companies for dayshift. The RN states she was never asked about the specific hours worked and she never talked about her other patient due to HIPAA. The RN also states that she informed the DON that she researched nursing regulations and it did not state anything about working with two patients in the same home. The RN adds that she never agreed to take care of one patient at a time in the same household or room.
