A nurse is willing to work, day and night, just to ensure that everyone is getting the health or medical assistance they need. This is the reason why a lot of people have high respect for them. Unfortunately, there are some professional nurses who do not take their jobs seriously. Most often than not, they commit acts that would place themselves in a compromising situation. What is even worse is that in the process of being negligent, they also start to place the lives of their patients in negligence. At the time of the incident, she was employed as an LVN with a health care facility in Fort Hood, Texas, and had been in that position for four (4) years and nine (9) months.
On or about March 2019, through May 2020, while employed as an LVN with a healthcare facility in Fort Hood, Texas, and assigned to provide skilled nursing services to a patient, LVN violated the professional boundaries of the nurse/client relationship by inappropriately engaging in an intimate relationship with the patient’s father. In addition, LVN accepted monetary gifts from the patient’s father and sent intimate photos to the patient’s father via text message while on duty. LVN’s conduct was likely to injure the patient in that it could have resulted in confusion between the needs of the nurse and those of the patient and/or the patient’s family.
In response, LVN admits to having an intimate relationship with the father of her patient during her capacity as a nurse. LVN admits to accepting monetary gifts and earrings from the father but states she did not ask for the gifts. LVN further admits pictures of her, and the patient’s father circulated among their social groups. LVN states that her patient always received proper care, and LVN claims she ended her relationship with the patient’s father in May 2020.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B)&(1)(J) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4)&(6)(D).
Unfortunately, the Texas Board of Nursing found her guilty of her deeds. Her LVN license was subjected to disciplinary action. She did not hire a skilled Texas BON attorney to fully defend her case which led to this decision by the Texas Board of Nursing.
