Every person who wants to become a professional nurse needs to go through several processes. First, there is a need to complete tertiary education in a nursing school. After graduation, the next step is to take the nursing board examination. The goal is to pass the said exam to become part of a professional nurse. Therefore, RNs and LVNs should be more careful whenever they are on their duty. All these only show that the process is not easy. Hence, every RN/LVN must take care of their license. At the time of the initial incident, she was employed as an LVN at a rehabilitation facility in Frisco, Texas, and had been in that position for six (6) months.

On or about October 10, 2018, through December 22, 2018, while employed as an LVN at a rehabilitation facility in Frisco, Texas, LVN received payment for hours, including overtime, that she did not actually work or provide nursing care.

In response to the above incident, LVN states she didn’t know she had received payment for hours she did not work. LVN states she didn’t pay close attention since the facility directly deposited her check. LVN asked if she could voluntarily work to pay back what they claimed she had been overpaid but was told not to come to the building. According to LVN, she has learned from this incident and should be more careful and pay attention to any direct deposit pay arrangements in the future. While working at the rehabilitation facility, LVN states she did rely on Human Resources and the DON to keep track of the hours every employee worked. LVN apologizes for any unintentional error on her part.

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.12(1)(B)&(6)(H).

However, without enough evidence to prove she’s not guilty, the LVN lost the case. This is the reason why the Texas Board of Nursing placed her LVN license under disciplinary action.
