Accusations, complaints, allegations towards an RN or an LVN are reviewed and evaluated by the Texas BON, if they need to be disciplined or not. At the time of the initial incident, she was employed as an LVN with a rehabilitation facility in Harlingen, Texas, and had been in that position for three (3) years and eight (8) months.
On or about August 17, 2018, while employed as an LVN with a rehabilitation facility in Harlingen, Texas, LVN lacked the fitness to practice vocational nursing when she overdosed on her medication in an attempt to commit suicide. Furthermore, on or about September 21, 2018, LVN was assessed by a physician and deemed unsafe to practice due to her continued use of methamphetamines. LVN’s condition could have affected her ability to recognize subtle signs, symptoms, or changes in patient’s conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger.
In response, LVN states that she never attempted suicide, but that she wasn’t taking her medication correctly and some days were doubling up because she couldn’t remember if she took it before or after work. Additionally, LVN states she’s had some ups and downs since August but has gotten herself on the right track and states she’s ready to deal with this the rest of her life.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10),(12)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(B)&(1)(T) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(1)(E),(4)&(5).
Unfortunately, the Texas Board of Nursing found her guilty of her deeds. Her LVN license was subjected to disciplinary action. She did not hire a skilled Texas BON attorney to fully defend her case which led to this decision by the Texas Board of Nursing.
