On or about July 15, 2021, an LVN submitted an LVN Delinquent Renewal to the Board and falsely indicated he had last practiced nursing in December 2020 at a medical facility in Harlingen, Texas, prior to his license expiring on January 31, 2021. The said LVN had been employed continuously since September 2010 and continued to practice nursing on a delinquent license between February 1, 2021, and July 15, 2021. The LVN’s conduct was deceptive to the Board and misled patients, their families, fellow caregivers, and the public into believing that the LVN nursing practice was in compliance with all Board Rules and Regulations. 

In the aftermath of the circumstance, the said LVN fully admits that he did falsely indicate that he had last practiced nursing in December of 2020 while continuing to actively practice, and he was completely unaware that his license had expired until he received a call on July 15, 2021, from his supervisor. Due to the COVID-19 pandemic, the agency that he was working for went understaffed, and he was working a hectic schedule. The said LVN assures the Board that he never had the intention to practice with an expired license. When he submitted the delinquent renewal to the Board on July 15, 2021, the LVN acknowledged it was wrong to provide false information, but because he had never been in this type of situation, he was trying to avoid getting himself or his employer in trouble. 

Furthermore, the LVN failed to hire a nurse attorney to help her with her case. Because of this, the Texas Board of Nursing suspended and disciplined the LVN.
