Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines if not properly defended by a nurse attorney. As a matter of fact, the RN license and LVN license can even be suspended or revoked.

On or about December 13, 2019, while employed as a Licensed Vocational Nurse at a medical facility in Killeen, Texas, an LVN may have lacked the fitness to practice nursing in that she fell off a toilet and cut her lip, she was very sleepy and out of it”. When confronted the said LVN admitted that her treating physician had prescribed her new medications. The LVN’s conduct was likely to injure the patient in that it adversely affected her ability to recognize subtle signs, symptoms, or changes in the patient’s conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

It was on or about January 16, 2020, while employed as a Licensed Vocational Nurse, the LVN may have lacked the fitness to practice nursing in that she was “extremely loopy and sleepy“. When confronted the LVN admitted that her treating physician had prescribed her a new medication to which she had a reaction. The conduct of the LVN was likely to injure the patient in that it adversely affected her ability to recognize subtle signs, symptoms, or changes in the patient’s conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

On or about March 30, 2020, while employed as a Licensed Vocational Nurse, the said LVN may have lacked the fitness to practice nursing in that she was sent home due to being too drowsy and falling asleep during a patient procedure. When confronted the LVN admitted that her treating physician increased her medication dose, which caused the drowsiness. The action of the said LVN was likely to injure the patient in that it adversely affected her ability to recognize subtle signs, symptoms, or changes in the patient’s conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

It was on or about April 2, 2020, while employed as a Licensed Vocational Nurse, the said LVN may have lacked the fitness to practice nursing in that she was unable to focus or concentrate. The LVN was unable to complete her scheduled workday, was unable to drive, and had to have a family member pick her up. The LVN’s action was likely to injure the patient in that it adversely affected her ability to recognize subtle signs, symptoms, or changes in the patient’s conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

In response to the incidents that occurred, the said LVN states that due to factors beyond her control, an increase in the dosage of medication that was prescribed to her caused unwanted side effects. Since this time and seeing her physician, her medication has returned to its normal dosage and she has had zero issues.

However, the LVN without the help of an experienced nurse attorney to help her defend her case, the Texas Board of Nursing suspended and disciplined the LVN. 

The Texas Board of Nursing decided to revoke her license as a result of her actions. It’s because she failed to hire a good nurse attorney for the case, which is why her defense was not matched with the evidence that the Board possesses.
