There are different cases that are filed every single day before the Texas Board of Nursing (BON). LVN’s conduct resulted in an incomplete medical record and exposed the patient to a risk of harm in that failure to administer medications as ordered by the physician could have resulted in non-efficacious treatment of the patient’s condition.

In response to the above incident, LVN states that she had not been notified about failing to administer medication to this patient. If medication was not available, LVN states that she would denote this on the medication administration record by circling the date. 

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D),(1)(M)&(2)(A) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B)&(4).

However, without enough evidence to prove she’s not guilty, the LVN lost the case. This is the reason why the Texas Board of Nursing placed her LVN license under disciplinary action.
