At the time of the initial incident, he was employed as an RN at a hospital in Carrollton, Texas, and had been in that position for two (2) years and eleven (11) months.

On or about November 25, 2020, and November 26, 2020, while employed as an RN at a hospital in Carrollton, Texas, on two separate occasions, RN removed Hydromorphone 2mg from the narcotic cabinet, took a needle and syringe, and went directly to the restroom. Furthermore, RN failed to make entries in the narcotic log both times that he removed the Hydromorphone vials. Additionally, the two incidents were observed on video surveillance. RN’s conduct was likely to defraud the facility of the cost of the medication. 

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(12), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4),(5),(6)(G),(8),(10)(E)&(11)(B).

As a result, the Texas Board of Nursing decided to place his RN license under disciplinary action. It’s too bad that he failed to hire a nurse attorney for assistance, knowing that he had every reason to defend himself in the first place. His defense would have gotten better if he sought legal consultation from a Texas nurse attorney as well.
