On or about September 17, 2020, while employed as an RN at a healthcare facility in Lewisville, Texas, RN failed to appropriately intervene after a patient presented with a positive purified protein derivative (PPD), Chest X-ray and QuantiFERON tuberculosis testing results, in that RN failed to isolate the patient and also failed to report the patient’s tuberculosis (TB) status to the health department. Subsequently, the patient returned to school for approximately two (2) months after the positive test results prior to being admitted to the hospital for treatment. RN’s conduct was a violation of the Texas Health and Safety Code and exposed the patient to risk of harm from adverse complications of delayed treatment for tuberculosis. RN’s conduct also exposed the patient’s contacts to risk of harm from tuberculosis infection.
In response to the above incident, RN states the patient was carefully monitored, and a standard progression of tests were ordered to clarify and determine whether the patient had TB or another type of respiratory infection. RN also states the patient was given two (2) referrals to a pulmonologist and states the mother did not follow up on the referrals.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(D),(1)(M),(1)(O)&(1)(P).
The Texas Board of Nursing gave the RN enough time to defend the complaints filed against her.
