Confidentiality in a patient’s health information is very important. It is also the obligation of any health professionals who have access to the information to not expose or disclose any of it to anyone. At the time of the initial incident, she was employed as an RN at a hospital in Midland, Texas, and had been in that position for two (2) years and eight (8) months.

On or about February 6, 2021, while employed as an RN at a hospital in Midland, Texas, RN failed to respect a patient’s right to privacy in that she used her personal cell phone to take an unauthorized photo of the patient’s amputated leg without a valid medical reason. RN’s conduct exposed the patient unnecessarily to a risk of harm from disclosure of her confidential medical information without her written authorization.

In response to the above incident, RN admits to the conduct, and she states she is ashamed by her actions that night. She states she has a new understanding of patient privacy and what it means to a patient and what it would mean to her as a patient.

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(E).
