Being non-compliant with the terms in the Agreed Order could become a big problem and could be a risk to your license. It is why every RNs/LVNs facing disciplinary proceedings should take it seriously and be compliant with every term that is agreed upon to prevent the worst from happening. It is time that you need the help of a nurse attorney when undergoing disciplinary proceedings. 

On or about May 27, 2021, an RN from Seguin, Texas, became noncompliant with the Agreed Order for Peer Assistance Program issued to her by the Texas Board of Nursing on February 26, 2021. Noncompliance is the result of her failure to comply with all requirements of the Texas Peer Assistance Program for Nurses (TPAPN) participation agreement, in that the RN failed to return the items necessary to initiate participation in the Texas Peer Assistance Program for Nurses (TPAPN) within the required time frame. The RN failed to comply with Section I, Stipulation B of the Agreed Order for Peer Assistance Program dated February 26, 2021, which states, in pertinent part:

“B. Within ninety (90) days follow the effective date of this Order, RESPONDENT SHALL sign and execute the TPAPN participation agreement and complete the enrollment process… “

On or about June l, 2021, the RN was dismissed from TPAPN and referred back to the Board.

In response, the RN states she could not afford the immense cost of TPAPN. The RN states she cannot afford to enter into a rehabilitation program nor be without a job.

As a result of what happened, the RN is facing disciplinary action due to her misconduct. However, she failed to hire an experienced nurse attorney for proper assistance, causing her to undergo such procedures.

However, her lack of an experienced nurse attorney to properly defend and assist her during the disciplinary proceedings led to her voluntarily surrendering her license.
