An allegation or complaint could be serious case, which is why a nurse attorney is needed if you get accused of this kind of scenario. However, some who thought they were guilty of the charges failed to hire a nurse attorney just because they thought it’s the doom for their license already. But that is not entirely the case as there is still hope.

Unfortunately, an RN from Austin failed to do this which resulted in disciplinary action. Take note that the Texas Board of Nursing who handles all of the cases may affect the LVN’s license from receiving the suspension, disciplinary action, or revocation. However, with a right nurse attorney for the case, rest assured that the case can go according to the nurse’s favor, especially if the RN has a good defense against the case.

On or about April 1, 2016, through June 30, 2016, the RN withdrew fifteen (15) tablets of Hydrocodone 10/325mg, seven (7) tablets of Hydrocodone 5/325m, one (1) tablet of Alprazolam 0.25mg, two (2) tablets of APAP/Codeine #3, and three (3) syringes of Guiafen/Codeine 100/10mg from the Medication Dispensing System for patients, but failed to follow the facility’s policy and procedures for the wastage of any of the unused portions of the medications. Her conduct left in medications unaccounted for and placed the facility in violation of Chapter 481 (Controlled Substance Act) of the Texas Health and Safety Code.

On or about April 1, 2016, through June 30, 2016, the RN misappropriated fifteen (15) tablets of Hydrocodone 10/325mg, seven (7) tablets 011 Hydrocodone 5/325mg, one (1) tablet of Alprazolam 0.25mg, two (2) tablets of APAP/Codeine #3, and three (3) syringes of Guiafen/Codeine 100/10mg belonging to the facility and patients thereof, or failed to take the precautions to prevent such misappropriation. Her conduct was likely to defraud the facility and patients of the cost of the medications.

In response to allegations filed against her, the RN states: “When I was employed at the hospital, I did administer PRN medications without charting. I would plan on going back and charting but always just going busy with my 8-9 patients and never got around to it and forgot by the end of the day.”

.Unfortunately, without an experienced nurse attorney to help her defend her case, she was disciplined and suspended by the Texas Board of Nursing.
