On or about April 20, 2017, while employed Nurse in a hospital in Garland, Texas, the RN assigned a Certified Nursing Assistant (CNA), who did not possess current certification to administer controlled substances, to administer Hydrocodone to a patient. Her conduct was likely to injure the patient in that the CNA did not have the education, skill set, and/or required certification to correctly and safely administer controlled substances to the patient.
On or about the same day, the RN failed to assess the pain level of the patient before and after assigning a Certified Nursing Assistant (CNA) to administer Hydrocodone to the patient. Her conduct was likely to injure the patient in that failure to assess patient as ordered by a physician could have resulted in non-efficacious treatment.
The RN was given the chance to defend herself. She states she was on another hallway assisting with a patient in respiratory distress. She states the Certified Nursing Assistant (CNA), approached her and advised her that the patient was complaining of pain and could not wait.
The RN Respondent states she had her medication cart with her and she could not leave the respiratory distressed patient. In order to get everyone taken care of, the RN dispensed the medication and handed it to the CNA, to administer to the patient.
However, the lack of a skilled nurse attorney to defend her made her lose her case. The Texas Board of Nursing finds that her condition could have affected her ability to recognize signs and changes in patient’s condition. Furthermore, her condition could have affected her ability to make rational judgements and decisions regarding patient care, which could place the patient in danger.
Because of this, the LVN has been subjected for discipline.
