Any type of accusations can be defended, as long as there is a good and a right nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.

On or about January 1, 2014, through January 22, 2014, an RN from Houston withdrew three vials of Hydromorphone HCL 2mg from the Pyxis for patients but failed to document, and completely and accurately document the administration of the medication in the patients’ Medication Administration Records. Her conduct was likely to injure the patient in that subsequent caregivers would rely on her documentation to further medicate the patient which could result in an overdose. Additionally, her conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

Subsequently, the RN failed to follow the facility’s policy and procedure regarding wastage of any of the unused portions of the medication. Her conduct left medications unaccounted for, was likely to deceive the hospital pharmacy and place them in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

Because of this, the RN was summoned by the Texas Board of nursing to hear her side of the story. However, the RN failed to appear at the court and she also failed to hire a nurse attorney to help her defend her case.

Because of this incident, the Texas Board of Nursing then subjected the RN and her license into disciplinary action.

The accusation would have been defended by an experienced, skilled and the right nurse attorney, had the RN hired one. Hiring a right nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.

Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case.
