The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney.
One of the best examples where a client failed to hire the right nurse attorney will be discussed in this case.
On or about September 15, 2012, while employed as a Licensed Vocational Nurse in a medical facility in Dallas, the LVN failed to administer Diastat, an anti-seizure medication, to a patient after she received a verbal order to administer it from a physician.
The LVN’s had contacted the physician regarding the patient when the patient experienced increased seizure activity. Additionally, she failed to notify the patient’s family of the patient’s change in condition. The LVN’s condition could have left the patient unnecessarily to risk of harm from ineffective treatment which could have resulted in a delay in the patient’s recovery.
Because of this, the LVN was summoned by the Texas Board of Nursing. In response to the allegations against her, the LVN states that when she called the neurologist on call she got one who she had not spoken with before and that when the physician ordered Diastat be administered she attempted to explain that the patient’s regular physician had indicated that Diastat not be used unless the seizure activity lasted more than five minutes and that the patient was having cluster seizures and she was only calling to update the physician on the activity as ordered because she felt she was noticing more seizure activity on her shift when compared to the other shifts.
The LVN states that this is evident from the seizure documentation sheets that will be part of the patient’s medical record. She states that she did not wake the mother at the time of this call to the physician because there was no need to.
However, she failed to hire an experienced nurse attorney to help her defend her side of the story.
The LVN failed to properly present and defend her case against the court. She was disciplined warning to suspension of her LVN license by violating Texas Board of Nursing regulation.
