An experienced criminal nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. On or about June 27. 2014, the LVN was arrested in for driving under the influence of alcohol.

The investigation also found out that she was tested positive for alcohol consumption. She provided a blood sample for phosphatidyl ethanol {“PEth”) testing. PEth is a marker of ethanol consumption. Ethanol is the intoxicating agent found in alcoholic beverages.

The laboratory results noted that the measurement from the sample provided at the evaluation was 113 nanograms per milliliter, which laboratories described as extremely high and indicating, recent heavy ingestion of alcohol.

The doctor also diagnosed the LVN with, alcohol abuse and opined that she is not able to practice nursing with reasonable skill and safety at this time.

The Texas Board of Nursing has full jurisdiction over all cases regarding errors committed by an RN or LVN.  The following incident and defense against the case caused the Texas Board of Nursing to place the RN and her license into disciplinary proceedings.
