One such incident happened to an RN on or about April 7, 2008, while employed as a Register Nurse in a medical facility in Houston. During the said date, the RN allegedly was observed by another nurse withdrawing 16,800 unit vials of Epogen, and not the ordered 16,200 unit vials for a patient. The dose should have consisted of 1-10,000u vial, 1-3000u vial, and 1-2000u vial. The RN prepared 1-10,000u vial and 2-3000u vials, using overfill from 10,000u vial and 2-3000u vial without overfill, which made the dose 16,800u. The other nurse intervened and did not allow the RN to administer the incorrect dose of Epogen, as withdrawn. Her conduct was likely to injure the patient from non-efficacious treatment or adverse reactions from an excessive dose of Epogen

In response to the incidents, RN states: On April 7, 2008, our facility was being audited by the state. My technique of drawing up medications was being observed and I was nervous and made a medication error. My administrator took disciplinary action and has continued to monitor me and will do so for a minimum of eight weeks, post-incident. She will monitor me weekly after that time frame. The second allegation of having alcohol on my breath, I have never consumed alcohol in the workplace. I do have a few glasses of wine at home in the evenings. I would appreciate you considering me for the TPAPN program so this will not be a problem in the future.

An RN or LVN who violates the state laws and issuances from the Texas Board of Nursing (BON) should seek proper help from a nurse attorney.  Doing so could make or break their cases. As a matter of fact, the license can even be suspended or revoked if not defended properly.
