The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN in Texas. It is also the agency that is responsible for overseeing the practice of professional nursing all over the state of Texas. Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines if not properly defended by a nurse attorney. As a matter of fact, the RN license and LVN license can even be suspended or revoked.

A perfect example of this incident happened to an RN who was then employed in a medical center in Austin.

On or about August 12, 2017, through August 13, 2017, the RN failed to administer total parenteral nutrition (TPN) and intralipids (IL) to a patient as ordered by a physician, in that she set the TPN infusion rate to 7.8 ml/hr when the TPN infusion rate should have been 9.1 ml/hr.

The RN’s conduct was likely to injure the patient in that failure to administer tube feedings, treatments, and medications as ordered by a physician could have resulted in non-efficacious treatment.

On or about August 13, 2017, the RN falsely documented the amount of total parenteral nutrition (TPN) infused in the medical record for a patient. Further, she admitted to her Clinical Manager in an email that she changed her documentation. Her conduct created an inaccurate medical record and failure to administer medication as ordered by a physician could have resulted in non-efficacious treatment.

During the hearing, the RN states she hung the bag and adjusted the rate per physician’s orders. Subsequently, she states she gave a report and took her break. She states she returned an hour later and continued her shift. The RN states before she did her last feeding she noticed the rate on the IV pump was different from her charting. She states the IV pump rate was correct so she corrected her charting to reflect the pump rate. The RN further states she zeroed out the IV pump and gave a report to the oncoming nurse.

However, due to lack of evidence and expert nurse attorney to defend her, the RN was suspended and disciplined.

This is just one of the many cases why every nurse in Texas is expected to act with prudence in practicing the profession. Gross negligence, disobedience or any form of offense on the part of an RN or LVN is never excused.
