Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. On or about January 31, 2008, and February 1, 2008, while employed as an RN in a medical facility in Houston, the RN failed to administer Fortaz to a patient. Her conduct was likely to injure the patient in that failure to administer medications as ordered by the physician could have resulted in non-efficacious treatment.

On or about May 15, 2008, the RN falsely documented that she administered medications to a patient in the patient’s medication administration record (MAR), after throwing said medications in the trash. Her conduct created inaccurate medical records and was likely to injure the patients in that subsequent caregivers would not have accurate information on which to base their decisions for further care.

The RN was summoned before the Board to defend against the case. In response to the incidents, the RN states that she does not remember the incidents, and can neither confirm nor deny the allegations; however, she states that it is possible that she may have made the aforementioned practice errors.

The Texas Board of Nursing then subjected the RN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the RN hired one.
