Nurses can be working in very different conditions. They have to endure long hours and sometimes, poor and understaffed environment. Because of this, they sometimes commit negligence due to a stressful working environment. And if you received a complaint regarding negligence, you must seek the help of a nurse attorney for your defense.

An example of this happened to an RN in Tyler wherein accusations of negligence are filed against her during her work.

On or about August 20, 2018, the said RN from Tyler self-reported that while employed the hospital facility, she failed to follow the facility’s policy and procedure regarding wastage of unused medications. Her conduct was likely to deceive the hospital pharmacy and placed them in violation of Chapter 481 of the Texas Health and Safety Code (Controlled Substances Act).

In response to the accusation, the RN self-reported she was terminated for failing to document narcotic and controlled substance wasting. She explains she was ordered to give a urine specimen and blood alcohol level draw and complied. She apologizes for not documenting her waste but was retaining said waste medication just in case the doctor ordered a repeat dosage and to allow her patients quicker access to their ordered medication. The RN further states she understands now and has learned that medications, in particular, narcotics and controlled substances, need accurate documentation regarding administration, waste, and any additional information pertinent to said medication.

Because of this incident, the Texas Board of Nursing then subjected the RN’s license into disciplinary action.

The accusation would have been defended by an experienced and skilled nurse attorney, had the RN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
