The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney

One of the best examples where a client failed to hire the right nurse attorney will be discussed in this case. 

On or about November 9, 2014, while employed as a Staff Nurse in a hospital in Houston, the LVN failed to document in the medical record of a patient  that the patient was found by other staff members while the LVN was not at the bedside, disconnected from the ventilator, with a pulse of 48, and subsequently required manual ventilation.

The LVN’s conduct resulted in an incomplete medical record and was likely to injure the patient in that subsequent care providers would not have accurate or reliable information on which to base their care decisions.

Because of this, the LVN was summoned by the Texas Board of Nursing. The LVN states she was caring for and obtaining supplies for her other patient when she saw the Charge Nurse coming down the hallway and they heard the Code Blue. She states that the ventilator alarm was not audible and was found to be faulty as other staff members could not hear the ventilator alarm well. The LVN further states the patient was not a 1:1 assignment and she had another patient assignment.

However, she failed to hire an experienced nurse attorney to help her defend her side of the story.

The LVN failed to properly present and defend her case against the court. She was disciplined warning to a suspension of her LVN license by violating the Texas Board of Nursing regulation.

Avoid a similar thing from happening on your end. Make sure to find the right nurse attorney in case a complaint will be filed against you before the Texas Board of Nursing (BON).
