The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a Tyler nurse attorney.

On or about April 17, 2019, the RN allegedly signed off on an incorrect surgical sponge count for a patient as the circulator nurse for the patient’s surgery. As a result, on November 29, 2019, a surgical sponge was removed from the patient’s abdomen. Her conduct resulted in an inaccurate surgical sponge count and was likely to injure the patient from unnecessary pain, infection, internal tissue damage, and subsequent surgical procedure.

During the hearing, the RN states she understands that a retained sponge or any foreign body after surgery should never occur. She states, to her knowledge, she counted the sponges correctly and audibly for the team to hear. She states they used the whiteboard and the instrument count sheet.

The RN further states the operation took almost 4.5 hours, compared to the normal 2 hours and she stayed an hour and a half past her scheduled time to leave without breaks. She adds that at the time she was 9 months pregnant with a due date of April 21, 2019.

However, the RN failed to properly present and defend her case against the court. She was disciplined and warned to suspend her license by violating Texas Board of Nursing regulation.
