A licensed nurse in Texas whether an RN or an LVN can and may be subjected to a disciplinary proceeding before the Texas Board of Nursing. On or about March 28, 2019, while employed as a Licensed Vocational Nurse, the said LVN failed to immediately initiate cardiopulmonary resuscitation (CPR) upon observing Patient M.W. as unresponsive; instead, the LVN instructed an unlicensed staff member to initiate CPR and call 911 while the LVN left the room in search of an automatic external defibrillator (AED). Subsequently, another nurse initiated CPR, but the patient could not be resuscitated. The LVN’s conduct resulted in a delay in resuscitation efforts and may have contributed to the patient’s demise.

In response to the occurrence, the LVN mentioned that she assessed the patient and felt a weak pulse. The LVN further states she directed a staff member to start chest compressions, and she left the patient with the staff member in order to search for an automatic electronic defibrillator (AED) and to summon the registered nurse for assistance.

Therefore, based on the findings of the Board, the LVN received disciplinary action to ensure further safety and accurate documentation as she works in the future which may also serve as her lesson learned. She could have hired a nurse attorney for instances such as this.
