An experienced nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. On or about September 15, 2012, the RN exceeded her scope of practice as a registered nurse in that after she received a verbal physician’s order for Diastat 10mg NOW and to have the patient transported emergently for evaluation of the patient’s seizures, she did not administer the medication or call for emergent transport to an emergency department, and did not notify the physician of her decisions.

The RN’s conduct was outside her authorized scope of practice and exposed the patient unnecessarily to risk of harm from ineffective treatment and deprived the patient of the benefit of a physician’s expertise.

The Texas Board of Nursing has full jurisdiction over all cases regarding errors committed by an RN or LVN. Thus, she was called by the Board to defend against the case.

The RN disclosed that in early 2016 she received treatment for bipolar disorder. She has been continually receiving psychiatric treatment for her mental health condition. She states that her condition is being effectively controlled.

The following incident and defense against the case caused the Texas Board of Nursing to place the RN and her license into disciplinary proceedings. She would have sought assistance from a good nurse attorney to provide clarifications towards the case.
