On or about August 9, 2020, and August 10, 2020, while employed as an RN at a hospital in Brownsville, Texas, RN administered Morphine 2mg to a patient in excess frequency and/or dosage of the physician’s orders. RN’s conduct was likely to injure the patient in that the administration of Morphine in excess frequency and/or dosage of the physicians’ orders could result in the patient suffering from adverse reactions. Additionally, RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
In response to the above incident, RN states the patient had two (2) orders for morphine, one for morphine 2 mg and one for morphine 4 mg. RN relates the medication was not purposely given in excess but to control the patient’s pain.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D)&(3) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4),(6)(G),(8),(10)(C),(10)(E)&(11)(B).
Because of this, the RN was summoned by the Texas Board of Nursing to defend her side, but the RN failed to hire a nurse attorney to help her with her case and without proper defense, the Texas Board of Nursing then decided to place her RN license under disciplinary action.
